1/26/13 COURT RULING SAYS OBAMA's "RECESS" APPOINTMENTS WERE UNCONSTITUTIONAL:
"...The 3-0 decision specifically says
the five-member NLRB lacked a quorum after
Obama attempted to place his three candidates on
the board, and therefore had no authority to act.
"That's the problem the chairman of the NLRB
faces," said Babson of Gaston, who himself was
confirmed by the Senate in 2010. "The reasoning
arguably applies to every case that's been decided
by this NLRB."The Obama administration's appointees have turned the NLRB in an aggressive pro-labor
direction lately...The ruling also represents blowback for Democrats from a parliamentary maneuver they dreamed up to keep President George W. Bush from making recess appointments during his administration....The decision has extraordinary implications on a constitutional level, Babson added..."
